Registering, Compliance, Counseling, Removal

The following is a proposal detailing how an effective domestic violence registry will help victims of abuse.  This system can provide potential victims with the power to address the issue prior to a relationship getting to the point of violence.  There is currently a domestic violence database that uses similar methods, however; it does not treat the issue.  Our proposal treats the issue of violence through rehabilitation and counseling and gives the offender and his or her family the opportunity to heal.  It also provides a system that allows the offender to have his or her name removed if they comply with all court order mandates.

Registry Guidelines:

Registry affects offenders 18 years and older, convicted of the crime of domestic violence including:
  • Stalking
  • Physical Abuse
  • Assault
  • Documented verbal abuse
  • Restraining orders
  • Registry is governed by local police - similar to the sex offender registry.
  • Registry is for life-time unless offender applies for removal (see below).
  • Laughtenburg Amendment - Gun dealers will have access to registry to prevent offenders from purchasing firearms.

Removal:

An offender has the option to remove themselves from the registry through a series of regulations stated below.  Removal from the registry takes approximately five years.  However, with ample progress an offender can file an appeal of removal if counselors and court agree the offender is no longer a threat to society.
  • Compliance
  • Counseling:
    • The offender will be required to attend a couseling program, anger managment, abuse counseling, parenting classes (if applicable), and conflict resolution classes.
    • Two or more deviations or offenses automatically disqualifies offender for removal.
  • Complying with court orders.

Disputes:

If an offender has a dispute with the information on the registry, a written appeal may be filed to remove or amend the registry - proper documentation is required.
